§ 1. General provisions
- These Terms set out the rules for participation in the course “beChill® Exams Programme” (hereinafter: “the Course”), delivered by Maria Będzińska, trading as Sofroflow, hereinafter referred to as “the Organiser”.
- The Organiser is a certified beChill® Coach and delivers the Course in accordance with the methodology developed by Annette Ebbinghaus - trulyBalance Sàrl.
- The Organiser is a qualified sophrologist, a member of the International Sophrology Federation (ISF), and complies with the ISF Code of Ethics and Professional Conduct.
- The Course is addressed to young people aged 14–19 preparing for school examinations or interested in developing self-regulation skills.
- Booking a place on the Course constitutes acceptance of these Terms.
§ 2. Scope and organisation of the Course
- The number and length of meetings, the session dates and the group size are given in the description of the relevant edition of the Course at www.sofroflow.com. The edition description forms an integral part of the contract.
- The group does not exceed 10 Participants.
- Sessions take place in person or online via a video platform (for example Google Meet, Zoom or FaceTime).
- Participants receive access to the beChill® app with recordings of the exercises for independent practice at home - access is valid until the end of the school year in which the Course takes place.
- The Course is delivered in English. Explanations are given in Polish where needed.
§ 3. Participants who are minors
- Where the Participant in the Course is a minor, the booking is made by a parent or legal guardian, who accepts these Terms on the Participant’s behalf and takes responsibility for their participation in the Course.
- The parent or legal guardian consents to the child taking part in the exercises delivered as part of the Course and confirms that the child has no health contraindications to participation.
- The parent or legal guardian is required to inform the Organiser of any health, emotional or developmental circumstances that may be relevant to the child’s safe participation in the sessions - including whether the child is under the care of a doctor, psychologist or other specialist.
- The Organiser may decline a booking or propose a different form of support if she considers that group sessions are not appropriate for a particular Participant.
§ 4. Booking a place and payment
- A place on the Course is booked through the form available at www.sofroflow.com or by contacting the Organiser by email.
- Once a booking has been made, the Participant receives an email confirmation together with the payment details.
- The fee for the Course is PLN 880 and may be reduced under early-booking arrangements or discount codes, on the terms stated by the Organiser for each edition of the Course.
- The fee covers:
- the group meetings in accordance with the schedule for the edition concerned,
- access to the beChill® app with audio recordings until the end of the school year,
- supporting materials made available during the Course.
- Payment may be made by one of the following methods:
- standard bank transfer to the account given in the confirmation message,
- BLIK payment to the telephone number given in the confirmation message.
- On booking a place on the Course, a registration fee of PLN 280 must be paid, confirming the reservation of the place. The rules on refunding the registration fee are set out in § 5. The remaining amount must be paid no later than 3 days before the Course begins.
- Failure to pay within the specified period results in the place being released to the next person on the list.
§ 5. Cancellation and non-attendance
- The Participant has the right to cancel the Course up to 14 days before it begins. In that case the Organiser refunds the whole of the fee paid, including the registration fee, within 14 days of receiving written notice of cancellation (to maria@sofroflow.com).
- After the period referred to in clause 1 has expired - that is, less than 14 days before the Course begins - the Course fee, including the registration fee, is non-refundable.
- The provisions of clauses 1 and 2 do not limit the statutory right to withdraw from a contract concluded at a distance, available to a consumer within 14 days of its conclusion.
- Non-attendance by the Participant at individual sessions does not constitute grounds for a partial refund of the fee or for extending the duration of the Course.
- In the event of non-attendance, the Participant has the right to use the recordings in the beChill® app in order to work through the material independently.
- In exceptional, unforeseen circumstances (prolonged illness, hospitalisation), the Organiser may consider on a case-by-case basis whether participation can be transferred to the next edition of the Course.
§ 6. Cancellation or change of date by the Organiser
- The Organiser reserves the right to cancel the Course if the minimum number of Participants is not reached (fewer than 6 people) or for other significant unforeseen reasons.
- If the Course is cancelled by the Organiser, all fees paid will be refunded in full within 14 days.
- If the date of individual sessions changes for reasons beyond the Organiser’s control, those sessions will be held on another date agreed with the group.
§ 7. Protection of personal data (GDPR)
- The controller of Participants’ personal data is Maria Będzińska, trading as Sofroflow.
- Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).
- Participants’ personal data is processed for the following purposes:
- performance of the contract for participation in the Course,
- organisational contact (confirmations, reminders, subject-matter support, changes of date),
- issuing a receipt or invoice,
- fulfilling legal obligations incumbent on the Controller (for example accounting obligations).
- Personal data is stored for the period necessary to achieve the above purposes, and thereafter for the period required by law (including tax law).
- The Participant has the right to:
- access their personal data,
- have it rectified, erased or its processing restricted,
- data portability,
- object to processing,
- withdraw consent at any time.
- Participants’ personal data is not disclosed to third parties, with the exception of entities providing technical services on the Controller’s instructions (for example the supplier of the beChill® app, the accountancy office), which are bound by confidentiality.
- The Organiser keeps notes serving solely to deliver sessions and prepare subsequent ones. Notes are stored securely and are not disclosed to third parties.
- The Organiser takes part in supervision conducted by a qualified sophrologist, in the course of which matters arising from professional practice may be discussed. Supervision takes place without disclosing any data permitting identification of a Participant, and the person providing supervision is bound by confidentiality.
- Providing personal data is voluntary but necessary in order to complete a booking and take part in the Course.
§ 8. Copyright and course materials
- All materials made available to Participants during the Course - including recordings in the beChill® app, exercises, graphic materials, presentations and written studies - are the intellectual property of the Organiser or of trulyBalance Sàrl and are protected by copyright.
- Materials made available to the Participant are intended solely for their personal, non-commercial use.
- Access to the beChill® app is personal and may not be shared with third parties.
- The following are strictly prohibited:
- copying, reproducing, modifying and sharing materials with third parties in any form,
- publishing materials on the internet, on social media or through other channels,
- using materials for commercial or training purposes,
- recording sessions (audio or video) without the Organiser’s express written consent,
- taking screenshots during online sessions and distributing them,
- sharing the link to online sessions with third parties.
- Breach of the rules set out in this paragraph results in immediate exclusion from the Course with no entitlement to a refund of the fee, and may give rise to legal liability under the Act on Copyright and Related Rights.
§ 9. Rules of participation and confidentiality
- The Participant undertakes to take an active and courteous part in the sessions and to observe the rules of working together as a group.
- During sessions, Participants may share personal experiences. All Participants are required to maintain confidentiality in relation to information exchanged during sessions.
- Sessions are conducted without parents present. The Organiser informs the parent or legal guardian about the general course of the programme and about the Participant’s attendance. Anything the Participant shares during sessions remains confidential - subject to clause 4.
- Confidentiality is broken where the Organiser forms a reasonable suspicion that the health, safety or welfare of the Participant or of another person is at risk. In such a situation the Organiser informs the Participant and then contacts the parent or legal guardian without delay. In situations calling for urgent intervention, the Organiser takes the steps provided for by applicable law.
- Online sessions require the Participant to be in a place where they cannot be overheard by third parties and will not be interrupted. This is a condition of maintaining confidentiality towards the other Participants.
- The Organiser exercises due care in securing online meetings; however, no communications platform guarantees complete transmission security. The Organiser is not liable for access obtained by third parties circumventing the platform’s security measures.
- The Organiser reserves the right to exclude from the Course any Participant whose behaviour significantly disrupts the delivery of sessions or infringes the rights of other Participants. In such a case the Course fee is non-refundable.
§ 10. Scope and limitation of liability
- The Course is educational and developmental in nature. It is not a form of therapy or of psychological or medical advice.
- Where health, mental health or emotional difficulties are present, the Participant (or their parent / legal guardian) should discuss their participation in the Course with a doctor or psychologist.
- If in the Organiser’s assessment the Participant’s situation calls for a different form of support, the Organiser informs the parent or legal guardian and points them in the appropriate direction.
- The Participant may stop performing an exercise or withdraw from any part of a session at any time.
- The Organiser is not liable for:
- any consequences of performing exercises incorrectly or contrary to instructions,
- Participants’ examination results or academic achievement,
- technical problems arising from the Participant’s own devices or internet connection.
§ 11. Final provisions
- Matters not governed by these Terms are subject to the provisions of the Polish Civil Code and other applicable provisions of Polish law.
- The parties undertake to resolve any disputes arising from participation in the Course amicably. Should agreement prove impossible, the competent court will be the court having jurisdiction over the Organiser’s place of business.
- The Organiser reserves the right to amend these Terms. Amendments do not apply retrospectively to Participants who have already booked a place on the Course.
- These Terms are available for inspection at www.sofroflow.com and are sent to the Participant (or parent / legal guardian) at the email address given at booking.
